USE OF THE PLATFORM

This document is an electronic record in terms of the Information Technology Act, 2000 and rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the Rules and Regulations, privacy policy, and Terms of Use for access or usage of domain name www.inchpaper.com (“Website”), including the related mobile site and mobile application (hereinafter referred to as “Platform”).

The Platform is owned by Inchpaper Private Limited, a company incorporated under the Companies Act, 1956, with its registered office at 37/4, 2nd Floor, Inderpuri, Jacobpura, Gurgaon 122001, Haryana, India (hereinafter referred to as "Inchpaper").

Your use of the Platform and services and tools is governed by the following terms and conditions ("Terms of Use") as applicable to the Platform, including the applicable policies which are incorporated herein by way of reference. If you transact on the Platform, you shall be subject to the policies that are applicable to the Platform for such transactions. By merely using the Platform, you shall be contracting with Inchpaper Private Limited, and these terms and conditions, including the policies, constitute your binding obligations with Inchpaper.

For the purpose of these Terms of Use, wherever the context so requires "You" or "User" shall mean any natural or legal person who has agreed to become a buyer on the Platform by providing Registration Data while registering on the Platform as Registered Users using computer systems. Inchpaper allows the User to surf the Platform or make purchases only after registering on the Platform. The term "We", "Us", "Our" shall mean Inchpaper Private Limited.

When you use any of the services provided by us through the Platform, including but not limited to (e.g., Product Reviews, Seller Reviews), you will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, and they shall be deemed to be incorporated into these Terms of Use and shall be considered as part and parcel of these Terms of Use. We reserve the right, at our sole discretion, to change, modify, add, or remove portions of these Terms of Use, at any time without any prior written notice to you. It is your responsibility to review these Terms of Use periodically for updates/changes. Your continued use of the Platform following the posting of changes will mean that you accept and agree to the revisions. As long as you comply with these Terms of Use, we grant you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Platform.

ACCESSING, BROWSING OR OTHERWISE USING THE PLATFORM INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE, SO PLEASE READ THE TERMS OF USE CAREFULLY BEFORE PROCEEDING.

By impliedly or expressly accepting these Terms of Use, you also accept and agree to be bound by Inchpaper Policies (including but not limited to Privacy Policy available at Privacy Policy) as amended from time to time. If you do not agree to any of the terms enumerated in the Terms of Use or the Policies, please do not use the Platform. You are responsible to ensure that your access to this Platform and material available on or through it are legal in each jurisdiction, in or through which you access or view the platform or such material.

1. Membership Eligibility

Transactions on the Platform are available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872, including un-discharged insolvents, etc., are not eligible to use the Platform.

If you are a minor (i.e., under the age of 18 years), you may use the Platform or access content on the Platform only under the supervision and prior consent/permission of a parent or legal guardian. As a minor, if you wish to transact on the Platform, such transaction may be made by your legal guardians or parents. Inchpaper reserves the right to terminate your membership and/or refuse to provide you with access to the Platform if it is brought to Inchpaper's notice or if it is discovered that you are under the age of 18 years and transacting on the Platform.

2. Your Account and Registration Obligations

If you use the Platform, you shall be responsible for maintaining the confidentiality of your Display Name and Password, and you shall be responsible for all activities that occur under your Display Name and Password. You agree that if you provide any information that is untrue, inaccurate, not current, or incomplete, or if we have reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete, or not in accordance with these Terms of Use, we shall have the right to indefinitely suspend or terminate or block access to your membership on the Platform and refuse to provide you with access to the Platform.

Your mobile phone number and/or email address is treated as your primary identifier on the Platform. It is your responsibility to ensure that your mobile phone number and your email address are up to date on the Platform at all times. You agree to notify us promptly if your mobile phone number or email address changes by updating the same on the Platform through a one-time password verification.

You agree that Inchpaper shall not be liable or responsible for the activities or consequences of use or misuse of any information that occurs under your Account in cases where you have failed to update your revised mobile phone number and/or email address on the Platform.

If you share or allow others to have access to your account on the Platform (“Account”), by creating separate profiles under your Account or otherwise, they will be able to view and access your Account information. You shall be solely liable and responsible for all the activities undertaken under your Account and any consequences therefrom.

3. Communications

When you use the Platform or send emails or other data, information, or communication to us, you agree and understand that you are communicating with us through electronic records and you consent to receive communications via electronic records from us periodically and as and when required. We may communicate with you by email or by such other mode of communication, electronic or otherwise.

4. Platform for Transaction and Communication

The Platform is a platform that Users utilize to meet and interact with one another for their transactions. Inchpaper is not and cannot be a party to or control in any manner any transaction between the Platform's Users.

5. Privacy Practices

We understand the importance of safeguarding your personal information and have formulated a Privacy Policy to ensure that your personal information is sufficiently protected. Apart from these Terms of Use, the Privacy Policy shall also govern your visit and use of the Platform. Your continued use of the Platform implies that you have read and accepted the Privacy Policy and agree to be bound by its terms and conditions. You consent to the use of personal information by Inchpaper in accordance with the terms of and purposes set forth in the Privacy Policy, which may be subject to amendment from time to time at the sole discretion of Inchpaper.

6. Product & Services Information

Inchpaper attempts to be as accurate as possible in the description of the product on the Platform. However, Inchpaper does not warrant that the product description, color, information, or other content of the Platform is accurate, complete, reliable, current, or error-free. The website or mobile application may contain typographical errors or inaccuracies and may not be complete or current. The product pictures are indicative and may not match the actual product.

Inchpaper reserves the right to correct, change, or update information, errors, inaccuracies, or omissions at any time (including after an order has been submitted) without prior notice. Please note that such errors, inaccuracies, or omissions may also relate to pricing and availability of the product or services.

7. Product Use & Services

The products and services available on the Platform, and the samples, if any, that the Platform may provide you, are for your personal and/or professional use only. The products or services, or samples thereof, which you may receive from us, shall not be sold or resold for any commercial reasons.

In case any products or services purchased/received/availed cause side effects or don’t suit you, please note that Inchpaper is in no manner responsible for any manufactural side-effects or services. The manufacturer or service provider of the product or service shall be solely responsible for such side effects and consumer complaints. You should carefully read the individual terms and conditions related to the products and services and consult a specialist before use.

8. Recommendation of the Product & Services

Any recommendation made to you on the platform during the course of your use of the platform is purely for informational purposes and for your convenience and does not amount to endorsement of the product or services by Inchpaper or any of its associates in any manner.

9. Pricing Information

Inchpaper strives to provide accurate product and pricing information; however, errors may occur. Inchpaper cannot confirm the price of the product until you make the order. Without limiting the generality of Clause 8 (Cancellations, Refunds, and Returns) below, if a product/service is listed at an incorrect price or with incorrect information due to any technical error, Inchpaper shall have the right, at its sole discretion, to refuse or cancel any orders placed for that product/service, unless the product has already been delivered or the service has already been availed by you.

In the event that an item is wrongly priced, Inchpaper may, at its discretion, either contact you for instructions or cancel your order and notify you of such cancellation.

CANCELLATIONS, REFUNDS AND RETURNS

Please refer to our Cancellation, Refunds and Returns Policy provided on our Platform.

MODE OF PAYMENT

Payments for the products available on the Platform may be made in the following ways:

• Payments can be made by Credit Cards, Debit Cards, Net Banking, Wallets, e-Gift cards, UPI, and reward points.
• Credit card, Debit Card, and Net Banking payment options are instant payment options and recommended to ensure faster processing of your order.
• Cash On Delivery option is not available for orders outside India.

SHIPPING AND DELIVERY

Please refer to our Shipping and Delivery Policy provided on our Platform, as amended from time to time.

POLLUTION CONTROL COMPLIANCE

Inchpaper is working towards being compliant with the guidelines laid down by Central Pollution Control Board (CPCB).

USER CONTENT

The information, photo, image, chat communication, text, software, data, music, sound, graphics, messages, videos, or other materials transmitted, uploaded, posted, emailed, or otherwise made available to us ("User Content") are entirely Your responsibility, and Inchpaper will not be held responsible in any manner whatsoever in connection to the User Content. You agree to not encourage or assist or engage others, as well as yourself, in transmitting, hosting, displaying, uploading, modifying, publishing, transmitting, updating, or sharing any information that:

• Belongs to another person and to which the user does not have any right to.
• Is grossly harmful, harassing, defamatory, obscene, pornographic, paedophilic, libelous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating to or encouraging money laundering, gambling, trolling, propaganda, or otherwise unlawful.
• Harms minors in any way.
• Infringes any patent, trademark, copyright, or other proprietary rights.
• Violates any law for the time being in force.
• Deceives or misleads the addressee about the origin of such messages or communicates any information that is grossly offensive or menacing in nature.
• Impersonates another person.
• Contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer resource.
• Threatens the unity, integrity, defense, security, or sovereignty of India, friendly relations with foreign states, or public order, or causes incitement to the commission of any cognizable offense or prevents investigation of any offense or insults any other nation.

Inchpaper shall in no way be held responsible for examining or evaluating User Content, nor does it assume any responsibility or liability for the User Content. Inchpaper does not endorse or control the User Content transmitted or posted on the Platform, and therefore, accuracy, integrity, or quality of User Content is not guaranteed by Inchpaper. You understand that by using the Platform, you may be exposed to User Content that is offensive, indecent, or objectionable to you. Under no circumstances will Inchpaper be liable in any way for any User Content, including without limitation, for any errors or omissions in any User Content, or for any loss or damage of any kind incurred by you as a result of the use of any User Content transmitted, uploaded, posted, emailed, or otherwise made available via the Platform.

You hereby waive all rights to any claims against Inchpaper for any alleged or actual infringements of any proprietary rights, rights of privacy and publicity, moral rights, and rights of attribution in connection with User Content.

You hereby acknowledge that Inchpaper has the right (but not the obligation) in its sole discretion to refuse to post or remove any User Content and further reserves the right to change, condense, or delete any User Content. Without limiting the generality of the foregoing or any other provision of these Terms and Conditions, Inchpaper has the right to remove any User Content that violates these Terms and Conditions or is otherwise objectionable and further reserves the right to refuse service and/or terminate accounts without prior notice for any users who violate these Terms and Conditions or infringe the rights of others.

If you wish to delete your User Content on our Platform or in connection with our mobile applications, please contact us by email at info@Inchpaper.com and request you to include the following personal information in your deletion request: first name, last name, user name/screen name (if applicable), email address associated with our Platform, your reason for deleting the posting, and date(s) of posting(s) you wish to delete (if you have it). We may not be able to process your deletion request if you are unable to provide such information to us. Please allow up to 30 working days to process your deletion request.

INTELLECTUAL PROPERTY RIGHTS

The "Inchpaper" name and logo and all related product and service names, design marks, and slogans are the trademarks, logos, or service marks (hereinafter referred to as "Marks") of Inchpaper Private Limited. All other Marks provided on the Platform are the property of their respective companies. No trademark or service mark license is granted in connection with the materials contained on this Platform. Access to this Platform does not authorize anyone to use any Marks in any manner. Marks displayed on this Platform, whether registered or unregistered, of Inchpaper or others, are the intellectual property of their respective owners, and Inchpaper shall not be held liable in any manner whatsoever for any unlawful, unauthorized use of the Marks.

Inchpaper and its suppliers and licensors expressly and exclusively reserve all the intellectual property rights in all text, programs, products, processes, technology, content, software, and other materials, which appear on this Platform, including its looks and feel. The compilation (meaning the collection, arrangement, and assembly) of the content on the Platform is the exclusive property of Inchpaper and is protected by Indian copyright laws and international treaties. Consequently, the materials on this Platform shall not be copied, reproduced, duplicated, republished, downloaded, posted, transmitted, distributed, or modified in whole or in part or in any other form whatsoever, except for your personal, non-commercial use only. No right, title, or interest in any downloaded materials or software is transferred to you as a result of any such downloading or copying, reproducing, duplicating, republishing, posting, transmitting, distributing, or modifying.

All materials, including images, text, illustrations, designs, icons, photographs, programs, music clips, downloads, video clips, and written and other materials that are part of this Platform (collectively, the "Contents") are intended solely for personal, non-commercial use. You may download or copy the Contents and other downloadable materials displayed on the Platform for your personal use only.

We also grant you a limited, revocable, non-transferable, and non-exclusive license to create a hyperlink to the home page of the Platform for personal, non-commercial use only. The Contents and software on this Platform are to be used only as a shopping resource. Any other use, including the reproduction, modification, distribution, transmission, republication, display, or performance, of the Contents on this Platform, is strictly prohibited. Unless Inchpaper explicitly provides to the contrary, all Contents are copyrighted, trademarked, trade-dressed, and/or other intellectual property owned, controlled, or licensed by Inchpaper, any of its affiliates, or by third parties who have licensed their materials to Inchpaper and are protected by Indian copyright laws and international treaties.

 

LIMITED LICENSE

Inchpaper grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal, non-commercial use of the Platform. All rights not expressly granted to you in these Terms of Use are reserved and retained by the Platform and its affiliates. Inchpaper reserves the right, at any time, without notice, and at its sole discretion, to terminate your license to use the Platform and to block and prevent your future access to the Platform.

REPRESENTATIONS AND WARRANTIES

The Platform is provided to you "AS IS." We make no representations regarding the use or the result of the use/depiction of the Contents on the Platform in terms of their correctness, accuracy, reliability, or otherwise. Inchpaper shall not be liable for any loss suffered as a result of depending on the depiction of the Content on this Platform.

Your uninterrupted access to this Platform may be affected by factors outside our control, including internet unavailability, system maintenance, or service interruptions. Inchpaper reserves the right to change or discontinue any aspect of the Platform, including content and availability, without notice. Users must not infer that information provided is comprehensive or specific to their needs.

DISCLAIMER OF WARRANTY AND LIMITATION OF LIABILITY

The Platform is presented "AS IS." Inchpaper and its affiliates make no representations or warranties of any kind, express or implied, including but not limited to warranties of merchantability, non-infringement, or fitness for a particular purpose. To the fullest extent permitted by law, Inchpaper will not be liable for indirect, special, punitive, incidental, or consequential damages of any kind, including lost profits, arising from your use of the Platform.

No claims related to the use of the Platform or these Terms may be brought more than one year after the cause of action arose. Termination of your use of the Platform is your sole remedy for dissatisfaction.

LINKS AND THIRD-PARTY SITES

References to third-party names, marks, products, or services are provided solely as a convenience. Inchpaper does not endorse or take responsibility for third-party content or linked sites. Users link to such sites at their own risk and must review the terms and privacy policies of these sites independently.

TERMINATION

These Terms of Use are effective unless terminated by you or Inchpaper. You may terminate by discontinuing use of the Platform. Inchpaper may terminate at any time without notice and deny access to the Platform. Upon termination, you must destroy all materials obtained from the Platform. Termination does not cancel your obligation to pay for products already ordered or affect liabilities arising under these Terms.

INDEMNITY

You agree to defend, indemnify, and hold harmless Inchpaper, its employees, directors, officers, agents, affiliates, and partners from claims, liabilities, damages, costs, and expenses arising from your actions or violations of these Terms, laws, or third-party rights.

GOVERNING LAW AND JURISDICTION

The Terms of Use are governed by the laws of India, and disputes shall be subject to the exclusive jurisdiction of the courts in Gurugram. Arbitration for disputes will be conducted in Gurugram under the Arbitration and Conciliation Act, 1996.

Inchpaper may seek injunctive or provisional relief for intellectual property protection in any competent court.

PLATFORM SECURITY

Users are prohibited from violating the security of the Platform, including unauthorized access, probing, or interference. Violations may result in civil or criminal liability. Inchpaper may investigate and cooperate with law enforcement regarding such violations.

ENTIRE AGREEMENT

If any provision of these Terms is deemed invalid, the remaining provisions shall remain in effect. These Terms constitute the entire agreement between you and Inchpaper concerning the Platform and supersede prior communications. Changes to these Terms are effective upon posting to the Platform. Continued use signifies acceptance of these changes.
